Terms of Service

1. Purpose and Definitions

These Terms of Service (hereinafter "Terms") govern access to and use of the OpenTruth platform, operated by:

Definitions:

  • "Service": the OpenTruth platform, including the REST API (api.opentruth.ch), the web application (app.opentruth.ch), and the showcase website (opentruth.ch)
  • "User": any natural or legal person registered with the Service
  • "Analysis": the automated processing of a public YouTube video by the Service (transcription, claim extraction, factual verification, scoring)
  • "Verdict": the result of the automated analysis of a claim (true, false, mixed, unverifiable), generated by artificial intelligence models
  • "API Key": a technical identifier enabling programmatic access to the Service

2. Acceptance of Terms

Use of the Service implies full and unconditional acceptance of these Terms. If you do not accept these Terms, you must not use the Service.

By creating an account or using the API, you confirm that you have read, understood, and accepted these Terms.

3. Description of the Service

OpenTruth is an automated political discourse analysis platform. The Service:

  • Analyzes public YouTube videos of political speeches, debates, and parliamentary sessions
  • Extracts verifiable factual claims from transcriptions
  • Verifies these claims by cross-referencing public sources
  • Assigns validity scores based on natural language inference (NLI) models
  • Structures results as queryable data (RAG, knowledge graph)

The Service is currently in beta phase. Features, performance, and availability may change without notice.

4. Registration and User Account

4.1 Registration Requirements

  • Registration is open to any person of legal age
  • The User provides a valid email address and password
  • One account per natural or legal person
  • The User is responsible for the confidentiality of their credentials

4.2 API Keys

  • API keys are personal and non-transferable
  • The User is responsible for any use made with their API key
  • In case of compromise, the User must immediately revoke their key and generate a new one

5. Acceptable Use

5.1 Permitted Uses

  • Factual analysis of public political discourse
  • Academic and journalistic research
  • Fact-checking and information verification
  • Integration into democratic transparency tools

5.2 Prohibited Uses The User agrees not to:

  • Use the Service to generate disinformation or deepfakes
  • Manipulate or falsify Service results
  • Present Verdicts as absolute truths or legal opinions
  • Deliberately overload the API (DDoS attacks, abusive scraping)
  • Circumvent rate limits or security measures
  • Resell access to the Service without prior written authorization
  • Use the Service to harm the reputation of private individuals
  • Submit non-public or private content for analysis

5.3 Usage Limits Rate limits apply according to the subscribed plan. Systematic exceeding of these limits may result in account suspension.

6. Limitation of Liability

6.1 Nature of Verdicts Verdicts generated by OpenTruth are the result of automated processing by artificial intelligence models. They constitute data structuring, and are not:

  • Legal advice
  • Established truth
  • Political value judgment
  • Human fact-checking expertise

6.2 No Guarantee of Accuracy The Service is provided "as is". OpenTruth does not guarantee:

  • The accuracy, completeness, or relevance of Verdicts
  • Uninterrupted availability of the Service
  • The absence of errors in analyses

6.3 Limitation of Damages In accordance with Art. 100(1) of the Swiss Code of Obligations (CO), liability for intentional fault or gross negligence cannot be excluded. Subject to this:

  • OpenTruth shall not be liable for indirect, consequential, or incidental damages
  • OpenTruth' total liability is limited to the amount of fees paid by the User during the 12 months preceding the damaging event
  • OpenTruth is not liable for decisions made by the User based on Verdicts

6.4 Force Majeure OpenTruth is released from all liability in cases of force majeure, including but not limited to: third-party infrastructure outages, YouTube API changes, AI model unavailability.

7. Intellectual Property

7.1 Platform The Service, its source code, algorithms, interface, and documentation are the exclusive property of OpenTruth. Any unauthorized reproduction, modification, or distribution is prohibited.

7.2 Analysis Data

  • Analyzed videos are public YouTube content, subject to YouTube's terms
  • Structured analyses (claims, scores, graphs) generated by the Service are derived data
  • The User may use their analysis results within the scope of permitted uses (Section 5.1)
  • User queries belong to the User

7.3 No Transfer of Rights Use of the Service does not confer any intellectual property rights over the platform or its components.

8. Service Availability (SLA)

Beta phase: the Service is provided on a "best effort" basis.

  • No availability commitment (SLA) is guaranteed during the beta phase
  • Interruptions for maintenance, updates, or improvements may occur without notice
  • OpenTruth endeavors to minimize interruptions and inform Users accordingly

9. Pricing

9.1 Beta Phase During the beta phase, the Service is accessible free of charge with usage limits.

9.2 Plans (subject to change)

  • Freemium: limited access, basic features
  • Citizen: extended access, advanced features
  • Engaged Citizen: full access, API, dedicated support

Pricing terms will be communicated before the end of the beta phase. Existing Users will be informed at least 30 days before any billing begins.

10. Termination and Suspension

10.1 Termination by User The User may delete their account at any time from the application or by contacting hello@opentruth.ch. Deletion results in the erasure of personal data in accordance with our Privacy Policy.

10.2 Suspension or Termination by OpenTruth OpenTruth reserves the right to suspend or terminate an account in cases of:

  • Violation of these Terms
  • Abusive use of the Service
  • Non-payment (when applicable)
  • Request from a competent authority

In case of suspension, the User will be informed by email with an indication of the reason.

11. Data Protection

The processing of personal data is governed by our Privacy Policy, available at opentruth.ch/privacy. By using the Service, the User acknowledges having read this policy.

12. Governing Law and Jurisdiction

12.1 Governing Law These Terms are governed by Swiss law, excluding its conflict of laws rules.

12.2 Jurisdiction Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Lausanne, Canton of Vaud, Switzerland, subject to mandatory jurisdictions provided by law.

12.3 Amicable Resolution Before any legal proceedings, the parties agree to seek an amicable resolution of the dispute within 30 days.

13. Changes to the Terms

OpenTruth reserves the right to modify these Terms at any time. Substantial changes will be communicated via email or notification in the Service at least 15 days before they take effect.

Continued use of the Service after changes take effect constitutes acceptance of the modified Terms.

14. General Provisions

  • If any provision of these Terms is declared null or unenforceable, the remaining provisions shall remain in force.
  • Failure to exercise a right does not constitute a waiver of that right.
  • These Terms constitute the entire agreement between the User and OpenTruth regarding use of the Service.
